Laburpena: This article states the partial success of democratic liberal constitutionalism as a legitimating instrument in the processes of the discolonization of the XX century and of the modernization of the constitutional structures in Central and Oriental Europe at the fall of the communist regimes, and likewise, as a resistance instrument to face the authoritarian attacks in Latin America. The text analyzes the different processes of democratic transition in the globalization context with different social-economic and cultural contexts and the difficulties they have faced.
