Laburpena: The legalization of the privation of privileges procedure contained in the new Legal Penal Code presents some disagreements, inadequacies, or blanks dealing with the constitutional perspective that governs this subject. The normative maladjustment could justify itself due to the fact that the constituent ratified the guidelines referred to the state privileges when an inquisitive penal court law system was in force in the country, whose institutions, terminology, and underlying culture are irreconcilable with the new model of criminal persecution that replaces it. The article highlights the need to adjust the Fundamental Letter to the reality that the new penal law system imposes to preserve the principal of the constitutional supremacy, and so the Political Code receives the basic principals and the main institutions in which it is founded and can be considered an obligated reference for the faithful interpretation of the new penal legal order.
