Laburpena: The purpose of this paper is to put together some reflections related to the possibilities and conditions for the admission of oral litigation in Chilean civil law proceedings. Accepting the fundamentally written nature of this process, and attempting to clear away deeply rooted errors encountered in the doctrinal analysis of the legal principles, the premise presented here is the need for a change of norms that leaves room for greater degrees of oral effectiveness and accessibility in civil law such as is the current trend in various proceedings, but taking care not to fall into obscure or naïve questions and answers. Reasonableness, capacity, and utility together with the necessary investment in human and other resources are, in our judgement, the key elements to the acceptance and use of oral litigation, which should be understood as a form of proceeding, essentially contingent on and thus fundamentally serving the needs and capabilities that identify the legislator.
