Laburpena: The amendment to the Argenti-nean National Constitution in 1994 regar-ding municipal matters has caused several debates in many counties -as in the case of Mendoza- in which their constitutions do not contemplate this autonomy. In this document, the author studies the evolution of municipal law in Argentina, making a comparative study of the municipality in the Argentinean provincial constitutional regime. She points out the differences and similarities regarding territory and popula-tion, organization of power, elections and duration of mandates, resources and popular participation among other topics. The author also analyzes the doctrinal opinions and the argentine judicial precedents that stand out in this matter, outlining a possible solution to this problem, especially in the case of Mendoza's County.
